Bajaj Allianz directed to compensate for accident in faulty vehicle
NEW DELHI: Responding to a recent accident case due to mechanical defects in vehicle, the Delhi State Consumer Commission has declared that the injured driver can not be refused an insurance claim only because he did not own a valid license while the accident happened.
The decision was announced by the bench comprising Justice Barkat Ali Zaidi along with Kanwal Inder who put the decision in favour of the driver, thus giving the directive to the insurance firm to compensate for all the loss to the driver. The bench further gave a reference of a similar case handled in Supreme Court, and reasoned that since the accident took place on account of mechanical faults, the driver not having a valid license does not hold account here.
As per the directive issued by the bench, the Bajaj Allianz General Insurance is now supposed to pay for all the loss to the auto rickshaw driver named Ramesh Kumar. Kumar lost around 30 percent of vision in both his eyes when the vehicle’s faulty axle led to a major accident.
